1. About these terms
These Terms of Use (“Terms”) govern your use of the ReadComfy iOS app, website, and related services. ReadComfy is provided by Jan Macura, a self-employed natural person (OSVČ) under Czech law, IČO 29561825, Spojná 617/1, Bludovice, 736 01 Havířov, Czech Republic. Contact: janmacura01@gmail.com.
By downloading or using ReadComfy, you agree to these Terms. Apple's Standard EULA also governs the app license. These Terms supplement that EULA and do not replace any mandatory rights it or applicable law gives you.
2. Eligibility
If you are not old enough to enter a binding agreement where you live, a parent or legal guardian must review and agree to these Terms for you and authorize any purchase.
3. License
Subject to these Terms and Apple's Usage Rules, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use ReadComfy on Apple devices you own or control. ReadComfy is licensed, not sold. We and our licensors retain all rights not expressly granted.
4. What ReadComfy does
ReadComfy imports and displays supported books and documents, reflows and recognizes text, stores reading information locally, plays local audiobooks, and can read supported text aloud. Some formats, layouts, scans, languages, voices, links, or files may not work perfectly. OCR, reflow, search, reading estimates, and synthesized speech may contain errors and should not be relied upon where exact reproduction is safety-critical or legally significant.
5. Your books and lawful use
You retain ownership of content you import or create. Because that content stays on your device, you do not grant us a license to it. You are responsible for having the right to download, copy, import, convert, and use each file.
You must not use ReadComfy to infringe copyright or other rights, bypass digital-rights protections, access systems without authorization, distribute unlawful material, or violate applicable law. ReadComfy does not remove DRM and is intended for lawful, DRM-free material.
6. Third-party sources and services
The classics catalog, imported web addresses, Apple services, and other third-party content or services are controlled by their respective providers and governed by their terms and policies. We do not endorse or guarantee third-party content, availability, legality, accuracy, or security. Project Gutenberg availability or public-domain status may differ by country; you are responsible for checking the law where you live.
7. Listening purchase
Reading features are free. The optional Listening unlock is a one-time in-app purchase at the price shown by Apple before confirmation. Apple processes payment, taxes, Family Sharing eligibility, refunds, and purchase history under its terms. RevenueCat validates the transaction and makes the entitlement available to ReadComfy. We never receive your payment-card details.
You can restore an eligible purchase from ReadComfy Settings while signed into the relevant Apple Account. Refund requests must be made through Apple. “Lifetime” means the unlock does not expire or renew as a subscription; it does not guarantee that the app, a particular operating system, device, third-party voice, or App Store service will remain available forever. Nothing here limits mandatory consumer guarantees.
8. Privacy
Our Privacy Policy explains what stays on your device and the limited processing used for purchases, optional attribution, support, and website delivery.
9. Updates and availability
We may update, improve, replace, or discontinue features and may issue compatibility or security updates. Some changes may be necessary because of laws, App Store rules, operating-system changes, or third-party services. We do not promise uninterrupted or error-free availability, but mandatory rights and obligations concerning purchased digital content remain unaffected.
10. Intellectual property and feedback
ReadComfy, its design, code, branding, and original materials are protected by intellectual-property law. If you send feedback or suggestions, you allow us to use them without restriction or payment, but you retain ownership of any rights you already hold.
11. Disclaimer
To the fullest extent permitted by law, ReadComfy is provided “as is” and “as available,” without warranties beyond those that cannot legally be excluded. We do not warrant that every document will render, reflow, search, OCR, or play correctly. This disclaimer does not exclude statutory consumer rights, including rights relating to conformity of digital content.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss, loss of data, or loss caused by third-party content or services. Where liability cannot be excluded, it is limited only to the extent the law permits. Nothing in these Terms limits liability for intent, gross negligence, personal injury, fraud, or any other liability that applicable law does not allow us to limit.
13. Suspension and termination
You may stop using ReadComfy at any time by deleting it. We may suspend access to an online component if reasonably necessary to address abuse, security, or legal requirements. The license ends if you materially violate these Terms, subject to any notice and remedy rights required by law. Provisions that by their nature should survive termination will survive.
14. Governing law and disputes
These Terms are governed by Czech law, without regard to conflict-of-law rules. If you are a consumer, mandatory protections and courts available in your country of habitual residence remain unaffected.
Please contact us first so we can try to resolve a dispute. Czech consumers may also use out-of-court dispute resolution through the Czech Trade Inspection Authority (ČOI): coi.gov.cz. Consumers elsewhere may use a competent local ADR body where available.
15. Changes and contact
We may update these Terms to reflect changes to ReadComfy or applicable law. We will post the revised version with a new effective date and provide additional notice where required. If a provision is unenforceable, the remaining provisions continue to apply. Failure to enforce a provision is not a waiver.
